These Terms & Conditions apply to work supplied by South Lincs Resin & Paving Ltd (“we”, “us”, “our”) to customers (“you”, “your”).

These Terms & Conditions should be read together with your written quotation, contract, specification, any applicable Notice of Right to Cancel, guarantee documentation and any other documents provided to you before the work begins.

1. Quotations and Scope of Work

1.1 We will provide a written quotation setting out, where applicable, the proposed work, materials, specification and price.

1.2 The quotation is based on the information reasonably available to us at the time it is prepared.

1.3 Any changes to the agreed work or additional work requested by you will be discussed with you before the additional work is carried out and, where appropriate, confirmed in writing.

1.4 We will not knowingly carry out additional chargeable work without first making the relevant cost clear to you and obtaining your agreement, except where an urgent or necessary adjustment is reasonably required to complete the agreed work safely and appropriately.

2. Quotation Validity

2.1 Unless otherwise stated on the quotation, quotations are valid for 30 days.

2.2 A quotation may need to be reviewed if circumstances affecting the work change, including significant changes in material costs, site conditions or the scope of work.

2.3 If a change in price is necessary, we will explain the reason to you and seek your agreement before proceeding with the affected additional work.

3. Site Conditions and Ground Preparation

3.1 Our quotation is based on the information available to us and the visible condition of the site at the time of quotation.

3.2 Existing ground, drainage, access or structural conditions that cannot reasonably be identified before work begins may affect the work required.

3.3 If unexpected conditions are discovered which materially affect the agreed work, we will explain the issue to you and discuss any necessary changes and associated costs before proceeding, where reasonably practicable.

3.4 We may recommend additional preparation or remedial work where this is reasonably necessary for the proposed installation.

4. Deposits and Payments

4.1 Where a deposit or advance payment is required, the amount and purpose will be stated in the quotation or contract.

4.2 Any deposit or advance payment will be applied towards the agreed work, materials or other agreed costs.

4.3 The remaining balance is normally payable upon completion of the agreed work unless different payment arrangements are stated in the contract.

4.4 Payment methods accepted will be communicated to you before payment is due.

4.5 If you cancel a contract or the contract does not proceed, any deposit or advance payment will be dealt with in accordance with the contract and applicable consumer law.

4.6 We will not automatically treat a deposit as non-refundable in every circumstance. Where we are entitled to retain any amount following cancellation, this will be limited to amounts we are legally entitled to retain and, where applicable, reasonable losses or costs directly resulting from the cancellation.

5. Cancellation and Consumer Rights

5.1 Your cancellation rights depend on how and where the contract is made and the nature of the work.

5.2 Where statutory cancellation rights apply, we will provide the required information about those rights, together with a Notice of Right to Cancel and Model Cancellation Form where required.

5.3 If you have a statutory right to cancel, nothing in these Terms & Conditions removes or restricts that right.

5.4 If you ask us to begin work during an applicable cancellation period, we will explain the relevant requirements and any consequences before work begins and obtain any required request or confirmation from you.

5.5 Where applicable, if you cancel after requesting that work begins during the cancellation period, you may be required to pay an appropriate amount for services supplied up to the point of cancellation, subject to applicable law.

5.6 Certain contracts may be subject to statutory exceptions or different rules. Your individual contract and cancellation documents will explain the rights that apply to your particular circumstances.

5.7 To cancel, you may contact us using the contact details provided in your quotation or contract. You do not necessarily have to use the Model Cancellation Form where the law permits another clear form of communication.

5.8 Nothing in these Terms & Conditions affects any statutory cancellation, refund or other consumer rights that apply to you.

6. Starting Work

6.1 We will agree an approximate start date or timeframe with you where reasonably practicable.

6.2 Start dates may be affected by weather, site conditions, availability of materials, access, unforeseen circumstances or other matters outside our reasonable control.

6.3 We will keep you informed of significant delays where reasonably practicable.

7. Customer Responsibilities

7.1 You are responsible for providing reasonable access to the property and working area.

7.2 Before work begins, you should remove vehicles, personal belongings and other items from areas where work is to be carried out unless otherwise agreed.

7.3 You should tell us about any known matters that may affect the work, including known drainage issues, underground services, access restrictions or other relevant site conditions.

7.4 You should ensure that we have reasonable access to any agreed utilities or facilities required to carry out the work.

7.5 Where you have pets or other animals, you are responsible for keeping them safely away from the working area.

8. Workmanship and Completion

8.1 We will carry out the agreed work with reasonable care and skill.

8.2 The finished appearance of paving, resin and other external surfaces may be affected by the existing site, weather, materials, natural variations and other factors outside our reasonable control.

8.3 We will complete the work substantially in accordance with the agreed specification, subject to reasonable variations agreed with you or circumstances requiring reasonable adjustments.

8.4 On completion, we will provide any applicable completion or guarantee documentation.

9. Workmanship Guarantee

9.1 Where a workmanship guarantee is offered, the applicable guarantee period, terms, exclusions and conditions will be stated in the guarantee documentation provided to you.

9.2 A workmanship guarantee does not remove or reduce any statutory rights you may have.

9.3 The guarantee does not normally cover damage or defects caused by matters outside our workmanship, including misuse, accidental damage, third-party work, abnormal site conditions or other matters specifically excluded in the guarantee documentation.

9.4 If you believe there is a problem with our workmanship, please contact us as soon as reasonably practicable so that we have an opportunity to inspect the issue and, where appropriate, put it right.

10. Complaints

10.1 We ask customers to contact us as soon as reasonably practicable if they have any concern about the work.

10.2 We will consider complaints fairly and aim to respond within a reasonable period.

10.3 Where appropriate, we may arrange an inspection or request photographs or other information to help us understand the issue.

10.4 Nothing in this complaints procedure prevents you from exercising any statutory rights or remedies available to you.

11. Liability and Consumer Rights

11.1 We will be responsible for our obligations under the contract and applicable law.

11.2 Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

11.3 Nothing in these Terms & Conditions affects your statutory rights, including rights relating to services not being provided with reasonable care and skill or not being as agreed.

11.4 We are not responsible for delays or problems caused by circumstances outside our reasonable control, provided that this does not affect any liability or consumer right that cannot lawfully be excluded or limited.

12. Changes to the Agreed Work

12.1 If you request a change to the agreed specification, we will discuss the change with you.

12.2 Where the change affects the price, materials, timescale or specification, we will explain the relevant change before proceeding where reasonably practicable.

12.3 We will not rely on a hidden or unexpected term to impose additional charges.

13. Materials and Product Information

13.1 Materials will be selected in accordance with the agreed specification.

13.2 Natural materials and manufactured products may have variations in colour, texture, shade, aggregate appearance or other characteristics.

13.3 Where a particular material or product is unavailable, we will discuss suitable alternatives with you before making a material change to the agreed specification.

14. Photos and Marketing

14.1 We will not use photographs of your property for advertising or marketing purposes without obtaining appropriate permission.

15. Governing Law

15.1 These Terms & Conditions are governed by the law of England and Wales.

15.2 Any dispute will be dealt with in accordance with applicable law.

15.3 Nothing in these Terms & Conditions limits or excludes any consumer rights or legal remedies that cannot lawfully be limited or excluded.

16. General

16.1 If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

16.2 These Terms & Conditions are intended to be read together with the individual written quotation and contract provided to the customer.

16.3 If there is a conflict between these website Terms & Conditions and a specific written contractual term provided to the customer, the parties’ statutory rights and obligations will continue to apply and the relevant documents should be read together.
