1. Our Workmanship Guarantee

Where a workmanship guarantee is provided, South Lincs Resin & Paving Limited (“we”, “us”, “our”) guarantees the workmanship of the installation carried out by us for the period stated in your written quotation, invoice or separate guarantee certificate.

The applicable guarantee period will be confirmed in writing before or at the time the work is completed.

This guarantee is provided in addition to, and does not replace, your legal rights.

2. What the Guarantee Covers

The guarantee covers defects that are directly attributable to defective workmanship in the installation carried out by us during the applicable guarantee period.

If you notify us of a potential workmanship defect, we may reasonably inspect the work and surrounding area to establish the cause of the problem.

Where a defect is found to be covered by this workmanship guarantee, we will consider and provide an appropriate remedy in accordance with the terms of the guarantee and applicable law.

3. Matters Not Normally Covered by the Workmanship Guarantee

The workmanship guarantee does not normally cover defects, damage or deterioration caused by matters outside our workmanship, including:

* fair wear and tear;
* accidental damage;
* misuse or neglect;
* failure to follow reasonable care or maintenance instructions provided to you;
* damage caused by third parties after completion of our work;
* ground movement, subsidence or other movement of the underlying ground;
* failure, movement or deterioration of an existing sub-base, foundation, drainage system or other structure that was not installed by us; or
* any other matter specifically identified as an exclusion in your written quotation or guarantee certificate.

These exclusions do not apply where the issue is caused by, or results from, defective workmanship for which we are responsible.

4. Existing Ground and Sub-Base

Where we are installing our work over an existing ground, sub-base, foundation, drainage system or other structure that was not installed by us, we cannot guarantee the condition, stability or performance of that existing structure.

If we identify an apparent issue with an existing structure before or during the work, we will explain the issue to you where reasonably practicable and discuss any appropriate remedial work.

Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited.

5. Making a Guarantee Claim

If you believe there is a problem with our workmanship, please contact us as soon as reasonably practicable after becoming aware of the issue.

Please provide, where available:

* your name;
* the property address;
* your invoice or quotation number;
* a description of the issue; and
* photographs showing the issue.

We may arrange a reasonable inspection where necessary to assess the cause of the problem.

We will consider the claim fairly and will explain our findings and any appropriate next steps.

6. Transfer of Guarantee

Unless otherwise stated in writing, this workmanship guarantee is provided to the original customer and is not transferable to another person or property owner.

Any agreement to transfer the guarantee must be confirmed by us in writing.

7. Statutory Rights

This workmanship guarantee is a voluntary guarantee provided by South Lincs Resin & Paving Limited.

It does not remove, restrict or replace any statutory rights or legal remedies available to you.

In particular, where you are a consumer, your statutory rights concerning services supplied with reasonable care and skill continue to apply independently of this guarantee.

Nothing in this guarantee is intended to exclude or limit any liability, right or remedy that cannot lawfully be excluded or limited.

8. Guarantee Period

The guarantee period applicable to your particular work will be stated in your written quotation, invoice or separate guarantee certificate.

The guarantee applies only for the stated period and subject to these terms, but the expiry of the voluntary workmanship guarantee does not remove any statutory rights or remedies that may otherwise apply.
